摘要: 中國大陸近年來為因應經濟快速發展,並在追求技術自主與維護中國本土企業商業利益的指導原則下,已開始注重自有知識產權的研發與保護。以專利為例,中國專利申請量自2000年以來平均年增長率達22%,截至2007年為止專利申請總量已超過三百萬件,其中台灣企業佔有近二十萬件。我國至2007年為止核准國內企業對中國大陸投資總金額已達五百八十億台幣,佔我國對外投資之首位,比例超過70%。在知識產權的客觀環境上,中國已經越為世界工廠、世界市場,甚或為專利的世界專利主戰場之一,未來幾年內科技產業在中國大陸所面臨的知識產權糾紛將接踵而至。 本文探討中國大陸專利侵權損害賠償制度,透過法學實證研究之方法,提出中國大陸專利侵權賠償額之量化資訊與具體法律實務運作之交錯,檢視中國法院專利侵權判決,據以觀察不同屬性之專利侵權糾紛與法院判賠金額間之關聯性,並透過對法官學者之深度訪談,深度剖析中國法院對當事人舉證之證據能力與證明力之判斷,以及法院採行法定賠償之依據,探究法院審判實務上判定賠償額之原則。以期讓企業在中國大陸發生專利侵權糾紛時能快速擬定應對策略,使其評估在中國大陸發動專利侵權訴訟之經濟效益。
For responding fast economic growth in recent decades, China government has started to contemplate on the protection of intellectual property rights as well as emphasizing on pursuing independent technology development. Take patent rights as illustration, the average increase rate of applications from 2000 to 2007 has reached to 22%, and the total amount of applications has exceeded 3 millions, Taiwan enterprise holds nearly 200,000. On the other hand, the aggregate investment amount to China by Taiwan enterprises which Ministry of Economic Affairs Taiwan has approved has exceeded NTD 58.6 billions. Therefore it is foreseeable that China will be a major battlefield of patent controversies against by worldwide enterprises, Taiwan corporations especially. This article made a study of the damages compensations of China patent litigation and turned out quantity methodologies by means of legal science empirical study, which includes examination on 400 judgments of patent infringement cases issued by China courts and interviews with China scholars and judges. The research result may be a reference to estimate litigation efficiency, and furthermore provides a proposal to corporations for framing patent enforcement strategies against competitors in China.
